Terms of Use

This agreement is concluded between "Growth Strategy" LLC and the User, and contains all essential conditions for the provision of services and services on the site www.raf.academy to any legal entity or individual.

1. Terms and concepts

1.1. For the purposes of this document, the following terms are used in the following meaning:
  • The Agreement is this document posted on the Internet at the address: https://www.raf.academy/en/agreement.
  • Raf.academy is a professional portal designed for the exchange of educational material between Users (Students and Teachers).
  • The User is a person who has passed the registration procedure on raf.academy, who has accepted the terms of this Agreement.
  • A teacher is a user who has created and posted educational material.
  • A student is a user who has paid for an educational course.
  • Account is a User account on the portal - Raf.academy. Accounts are divided into student and teacher accounts.
1.2. The Agreement may use terms that are not defined in clause 1.1. In this situation, the interpretation of the term should be carried out according to the text of the Agreement. If there is no unambiguous interpretation in the text of the document, one should be guided by the interpretation given in the legislation of the Russian Federation, on the portal - Raf.academy, or established on the Internet.

2. Subject of the agreement

2.1 Raf.academy provides on a reimbursable basis a software and hardware complex of organizational, information and technical solutions that ensure interaction between Teachers (sellers) and Students (buyers).

3. Terms of Use

3.1. The full list of portal features is provided only to Users who:
  • have reached the age of 14;
  • are legally capable individuals;
  • have made acceptance of this Agreement;
  • have passed the Account registration procedure and (at the discretion of Raf.academy) identity verification;
  • logged in by entering the User's personal login and password.
3.2. Raf.academy has the right to change the terms of the Agreement at any time. If Raf.academy makes changes to the Agreement, they come into force from the moment they are posted on the Website.

3.3. By accepting this Agreement, the User grants consent to Raf.academy, as well as other companies, partners and third parties, at the discretion of Raf.academy, to process, use, store, and cross-border transfer of their personal data, for the purpose of fulfilling the Agreement, as well as for 50 years after its termination. The User's consent can be revoked at any time by notifying Raf.academy by registered mail to the legal address of the organization, with a statement on revocation of consent to the processing of personal data.

3.4. All materials listed on the Site are provided in the format "as is" and "as available".

3.5. Raf.academy, as well as our affiliated persons, suppliers, partners and agents, make no representations or warranties regarding the suitability, reliability, availability, timeliness, safety, error-free or accuracy of the Services provided or their materials, and explicitly disclaim any warranties or conditions (express or implied), including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement of intellectual property rights. Raf.academy, as well as our affiliated persons, suppliers, partners and agents do not give there are no guarantees that you will get concrete results from using the Services and Products. Your use of the Services (including any materials) is carried out solely at your own risk, based on your inner conviction and subjective interpretation.

3.6. The placement of links to third-party websites does not imply their approval by the company.

3.7. Raf.academy management body, director, beneficiary, as well as other persons and organizations affiliated with Raf.academy are not responsible to the User and other individuals and legal entities in any situation for:
  • any actions (omissions) that are a direct or indirect result of actions (omissions) User and third parties;
  • any indirect losses and (or) lost profits of the User and (or) third parties and regardless of whether Raf.academy could have foreseen the possibility of such losses or not;
  • use (inability to use) and any consequences of the use (inability to use) of the Services and Products selected by the User.

3.8. Without contradicting the information specified above, Raf.academy is not responsible for violation of the terms of the Agreement if this violation occurs under the influence of unforeseen circumstances (force majeure): actions of state authorities, fire, flood, earthquake, other natural actions, lack of electricity and (or) computer network failures, strikes, civil unrest, riots, any other circumstances beyond the control of Raf.academy and affecting the fulfillment of obligations assumed.

3.9. To the maximum extent permitted by law, Raf.academy excludes:
  • all conditions, representations, guarantees and other conditions that could be implied by legislative acts, common law, the law of justice or the subjective perception of a particular User;
  • any liability incurred by the User as a result of using the Services and Products of Raf.academy, including liability for claims, penalties, claims, losses, obligations, expenses of any nature and type: direct, indirect, incidental, punitive or consequential damages (including negligence), inability to use, loss of data, damage caused to a computer by an electronic virus, loss of income or profit, waste of office time, breach of contract or claims of third parties or other losses of any kind and nature, even if Raf.academy has been warned of the possibility of such damages or losses arising from or in connection with the use of Raf.academy Services and Products.
  • This limitation of liability applies, but is not limited to the transmission of any devices or viruses that may infect the User's equipment, cause malfunction of mechanical or electrical equipment or communication lines, telephone or other communication problems, unauthorized access, theft, personal injury, property damage, strikes or force majeure, including but not limited to liability for loss of income, loss of profits or contracts, loss of business, loss of expected savings, loss of reputation, loss of data, loss of office time and any loss or damage of any kind.
3.10. It has been explained to the User, and he agrees that there are no guarantees of achieving the desired result (increasing the level of education, acquiring professional skills and other benefits that the User seeks to obtain) and there cannot be.

3.11. Raf.academy is not responsible for the illegal use of the Site's services.

3.12. Once again, in simple words– we make every possible effort to ensure that the information posted on the portal is reliable, useful, safe for practical use and complies with the current legislation of your country, but something can always go wrong. Moderators of our company do not have professional knowledge in all areas and may miss low-quality material. We also do not have the authority to determine the legality of published materials. In this case, all responsibility for the distributed content is borne by its creator. From the submitted materials, you can get information that you find offensive, obscene, questionable, will cause damage, including physical damage (for example, when taking courses from the Medicine and Health section). You acknowledge the risks and dangers associated with such materials, and when registering to access such materials, you voluntarily assume such risks, including the risk of illness, injury, disability or death. You assume full responsibility for your decisions that you made before, during and after your registration to access the materials. Raf.academy does not hire or hire teachers, and we are not responsible for the interaction between Teachers and Students. Raf.academy is not responsible for disputes, claims, losses, injuries or damages of any kind that may arise as a result of or in connection with the behavior of Teachers or Students. You agree to waive any claims against us.

4. General rules of User behavior

4.1. The rules for Teachers and Students are described in separate regulations.

4.2. The user must:
  • When registering on the Site, specify the real identification, contact details, address, document issued by a state institution and other requested information;
  • If necessary, within 3 (three) days from the date of sending, provide/send scans or copies of notarized documents required for identity verification;
  • In case of receiving a request for additional documents/materials from Raf.academy, execute it within 3 (three) days from the date of sending;
  • Monitor the relevance and, in case of changes, update the information about yourself available in your Personal Account within 10 (ten) days;
  • Independently choose the Service and Products on the Website.
  • When using the Services and Products of the Site, fully comply with all the requirements of the "User Agreement";
  • At least once in 7 (seven) days, review the Agreement for changes in its content. If the User does not agree with the changes made, he is obliged to immediately stop using the services of the Site;
  • When working with the Services and Products of the Site, comply with the legislation in force in the territory of residence/ location, including those related to countering the legalization of proceeds from crime and the financing of terrorism;
  • Refuse to use the Services and Products of the Site if they violate the legislation in force in the territory of the User's residence/location;
  • In case of making a profit using the Services and Products of the Site, bear full responsibility for the payment of taxes, fees and other payments provided for by the legislation in force in the territory of the User's residence/location;
  • Independently resolve any disputes, complaints and claims of third parties, regulations and requirements of state and municipal authorities to the User or Raf.academy regarding unauthorized use of the Services and Products of the Site by the User and at his expense. The User undertakes to cover all losses and expenses incurred by Raf.academy as a result of such claims and lawsuits;
  • Independently ensure the secrecy of the login and password required to access the Site's services;
  • Check the e-mail specified as a contact at least once a day;
  • Be responsible for all materials published by him on the Site (reviews, comments, publications, courses, etc.);
  • Comply with the legislation in force in the territory of its location;
  • Exercise reasonable care when transferring personal information.
4.3. The Contractor is not entitled to:
  • Copy, modify, create derivative works and distribute the content available to the User in the Personal Account, except in cases when the User has received written permission for these actions from Raf.academy;
  • Use images, works, videos, logos and other intellectual property of Raf.academy without written permission;
  • Publish, upload and store materials that violate applicable local or national laws, international law, intellectual property;
  • Use software capable of harming the Site, or otherwise affecting its correct operation, as well as allowing you to copy the materials provided, automate work with the Site;
  • Perform actions that may in any form, indirectly or directly, negatively affect the business reputation of the Raf.academy;
  • Perform actions that may in any form, indirectly or directly, negatively affect the normal functioning of the Site;
  • Use an invalid or unauthorized payment method when making a purchase;
  • Transfer rights by Agreement to a third party.
4.4. User Responsibility:
  • All actions performed using the User's login and password are considered to be performed by the User. The User is solely responsible to third parties for all actions performed using the User's login and password. Raf.academy is not responsible for unauthorized use of the User's registration data by third parties;
  • The user is solely responsible for the accuracy of the information provided, for violating the rights of third parties when posting such information on the Raf.academy portal.
4.5. The user has the right to:
  • For unhindered and round-the-clock access to the Services and Products of the Site;
  • Request the deletion of the Account and personal information, if this does not interfere with the fulfillment of the obligations assumed by Raf.academy.
4.6. The student has the right to:
  • For lifetime access to paid Products and Services, except in cases when Raf.academy is obliged to remove materials by law or in connection with the terms of agreements;
  • For a refund of funds paid for Products and Services, if no more than 30 days have passed since the purchase, and the educational course has been completed by no more than 30%.

5. Raf.academy Rights

5.1. The specifics of Raf.academy's work with Teachers and Students are described in separate regulations.

5.2. Raf.academy has the right to:
  • Independently determine the pricing policy, conduct promotions, provide special offers and personal discounts, without specifying it in the documentation (including payment);
  • Temporarily suspend the operation of Services and Products for technical, technological or other reasons that hinder the provision of Services, for the time of elimination of such reasons;
  • Suspend the operation of Services and Products and/or block the User's Account with or without notice, in case the User violates the obligations assumed by the Agreement, or commits other actions prohibited by law, business practices, moral and ethical norms, as well as in case of suspicion of committing the above actions. In addition, Raf.academy reserves the right to block the Account for other reasons not included in the terms of the Agreement. Materials published by the User may be available on the Site, even if the Account is blocked;
  • When verifying the User as a counterparty, when making payments, when receiving the User's application for a refund in other situations at its discretion, Raf.academy has the right to request any documents identifying the User's identity, as well as documents confirming the User's right to meet the requirements.
  • To share the User's materials that he places on the Site with any persons by any means, including through advertising on other Sites without written permission from the User;
  • Make any changes to the operation of the Site at any time;
  • Request any documents at the discretion of Raf.academy confirming the User's right to the published materials;
  • Demand from the User additional information/data/materials necessary for the publication of the content provided by them;
  • Delete any material published by the User in case of copyright infringement or otherwise at the discretion of Raf.academy;
  • To delay or stop any payments due to the User if Raf.academy has reasonable doubts about the legality of these operations;
  • To send advertising and informational messages to the User, mailing lists, including over the mobile radiotelephone network, from Raf.academy, its contractors and affiliates;
  • Transfer the rights under this Agreement to another company or individual without any restrictions.
5.3. If Raf.academy is unable to exercise any rights, powers or intentions under the Agreement or insist that the User strictly comply with the terms of the Agreement, this does not mean that Raf.academy waives the terms and conditions of the Agreement or its rights to require the User to comply with the terms of the Agreement in the future.

6. Financial conditions

6.1. Payment for Services and Products by the User is made on the terms of advance payment in the amount of 100% of the cost.

6.2. The User chooses the method and form of payment for the Purchase on the Site at his own discretion. Security, confidentiality and other terms of use of the payment method and form chosen by the User are regulated by agreements between the User and the relevant organizations.

6.3. The purchase is considered paid by the User from the moment when Raf.academy receives confirmation from the bank that the entire payment amount has been credited to the current account.

6.4. Depending on the User's place of residence, the price of Services and Products may include taxes on use and sales tax, goods and services tax or value added tax.

6.5. The user understands and agrees that he is responsible for all taxes on income received with the help of Raf.academy.

6.6. The maximum period for transferring any payments due to the User from Raf.academy is set at 60 (sixty) days.

7. Intellectual property

7.1. By publishing the material, the User guarantees that he is the owner of all the rights and powers necessary to perform these actions, as well as to transfer permission to Raf.academy to use any materials published by the User, including without payment of any compensation. At the same time, the User waives all privacy rights.

7.2. When publishing the material, the User grants Raf.academy a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, demonstrate and distribute the User's materials, including his name and image, by any means or methods of distribution, for any purpose at the discretion of Raf.academy.

7.3. When publishing the material, the User undertakes to comply with the legislation in force at his location, as well as:
  • Madrid Agreement on the International Registration of Marks;
  • Convention on the Protection of Industrial Property;
  • Berne Convention for the Protection of Literary and Artistic Works;
  • Convention on the Protection of the Interests of Phonogram Producers from Unlawful Reproduction of their Phonograms ;
  • The World Copyright Convention.

8. Term, modification and termination of the Agreement

8.1. By registering an Account, the User accepts the terms of this Agreement.

8.2. The Agreement comes into force from the moment of registration by the User and is valid until the Parties fulfill their obligations.

8.3. The User agrees and acknowledges that if changes are made to the Agreement, these changes also apply to the Agreement concluded earlier and in force between the User and Raf.academy. Moreover, the changes are considered valid from the moment of their publication.

8.4. The Agreement may be terminated at the initiative of the User at any time, provided that he has no obligations to Raf.academy. In other cases, the User is obliged to notify Raf.academy of the intention to terminate the Agreement at least 60 (sixty) days before the termination date. The notification is submitted in a free form through the support service.

8.5. The Agreement may be terminated at the initiative of the Raf.academy at any time in the cases provided for by the Agreement.

8.6. If any of the terms of the Agreement is declared invalid or does not comply with the law, this condition is removed from the Agreement and replaced with a new provision that best meets the original intentions reflected in the Agreement. At the same time, all other provisions do not change and remain in effect.

9. Guarantees

9.1. During the term of the Agreement, Raf.academy undertakes to eliminate as quickly as possible any failures and errors that have occurred in the operation of the Site. Raf.academy does not guarantee that errors and failures will be absent during the term of the Agreement.

9.2. The User accepts the condition according to which no claims are made to Raf.academy if the interruptions in the operation of the Site were caused by objective circumstances related to:
  • power outages;
  • global disruptions in the work of the Russian and international segments of the Internet;
  • routing system failures;
  • failures in telecommunication and energy networks;
  • actions of malicious programs, expressed in disabling the software and/or hardware complex of each of the Parties;
  • failures in the distributed domain name system;
  • failures caused by hacker and DoS (Denial of Service) attacks;
  • fires and other emergencies in the company's data centers.
9.3. Raf.academy provides only the guarantees directly specified in the text of the Agreement. Raf.academy does not provide any other (indirect) guarantees and is not responsible for violation of rights, non-compliance of Services and Products with certain purposes of Users.

9.4. Raf.academy disclaims liability for damages to the extent that such liability can be excluded or limited by applicable law.

Conditions for teachers

This agreement is concluded between LLC "Growth Strategy" and the User registering on the Site as a Teacher. The main terms of use of the Site are reflected in the User Agreement. Conditions for teachers are posted on the page www.raf.academy/teachers-oferta

1. Teacher's Obligations

1.1. The teacher is fully responsible for all materials posted by him, including lectures, exercises, tests, assignments, answers, laboratory work, control tasks, announcements, etc.

1.2. By accepting the terms of this Agreement, the Teacher guarantees that:
  • Has the necessary licenses, rights, consents and approvals and has the authority to post educational materials;
  • The provided materials do not constitute an illegal appropriation of any intellectual property right of a third party and do not violate it;
  • Has the necessary qualifications, titles and experience to teach and offer services;
  • Will ensure the quality of services that meets the standards of the industry, specialization or field of knowledge and training services in general;
1.3. The teacher undertakes not to:
  • publish or transmit unsolicited and unauthorized advertising, promotional materials, unsolicited mail, spam or any other forms of imposition of services;
  • interfere with or otherwise oppose other teachers in the provision of their services or materials;
  • Abuse the resources of the Raf.academy.

2. License

2.1. The Teacher grants Raf.academy the rights specified in the User Agreement to offer, sell and otherwise use the provided materials. Raf.academy has the right to add subtitles or otherwise modify the Teacher's materials to ensure their availability. Raf.academy also has the right to transfer materials to third parties, including with the participation of resellers, distributors, affiliated sites, special application sites and paid advertising services on third-party platforms.

2.2. Unless otherwise agreed, the Teacher has the right to delete all or part of his materials at any time. Except for separately specified cases, the right of Raf.academy to grant sublicense rights from this section will cease to apply to new users after 30 days after the removal of materials. At the same time, the Teacher agrees that the rights granted to Students prior to the removal of materials will remain valid in accordance with the terms of these licenses (including the provision of lifetime access).

2.3. Raf.academy has the right to record and use all or part of the materials provided by the Teacher for the purposes of quality control and provision, marketing, advertising, demonstration or maintenance of Services. The teacher authorizes Raf.academy to use his name, likeness, image and voice in connection with the offer, provision, marketing, advertising, demonstration and sale of Services. The teacher waives all rights to confidentiality, public use or other rights of a similar nature to the extent provided for by applicable law.

3. Terms of Use

3.1. Raf.academy has the right to remove materials, suspend payments and/or block Teachers for any reason at any time without prior notice, including in cases where:
  • The teacher or the material published by him does not meet our requirements and rules;
  • The material is considered to be of poor quality or negatively affecting the experience of students;
  • The teacher commits actions that may adversely affect the company or its reputation, cause public contempt, involve the company in a scandal or make it the subject of ridicule;
  • At your own discretion.
3.2. Raf.academy allows a Teacher to add other users as fellow teachers or teaching assistants. By adding a fellow teacher or teaching assistant, you understand that you are giving them the right to perform certain actions that affect your account and the materials provided. Violation of the Raf.academy rules by your teaching colleague or teaching assistant may also affect your account and the materials provided. The teacher undertakes to independently settle all issues related to intellectual property with the teacher-colleague or teacher's assistant.

4. Financial conditions

4.1. Raf.academy pays Teachers a share of income ranging from 5 to 30% of the net profit received from the sale of Teacher materials after paying all taxes, fees and other deductions established by the legislation of the countries or partner agreements. The size of the share, as well as the cost of materials, is determined after passing moderation.

4.2. Raf.academy has the right to share the Teacher's materials with its employees and individual partners for free. Teachers do not receive compensation in such cases.

4.3. The teacher independently chooses the method of receiving payments from those presented on the Site.

4.4. In the case of a refund to Students, Teachers do not receive any income from the sale for which the refund was issued. If the refund was issued after the transfer of remuneration to the Teacher, Raf.academy has the right to withhold the refund amount from future payments due to the Teacher.

5. Other conditions

5.1. If the Teacher's Account or materials are deleted, his name and the provided materials remain available for life for Students who have previously purchased them.

5.2. Raf.academy has the right to make changes to this Agreement, in which case all changes will take effect from the moment they are published.
